Solicitud de nulidad del proceso que culminó con la Sentencia C-337/21.

El peticionario señaló que el expediente carecía de decisión sobre la manifestación de impedimento de la Magistrada Cristina Pardo Schlesinger, por lo que se configuraría la causal de nulidad prevista en el artículo 133 del Código General del Proceso.

Además solicitó información sobre la norma reglamentaria aplicada para proferir la decisión durante una sesión distinta a la establecida con miras a ese propósito.

Luego de no advertir la existencia de irregularidad procesal alguna, y mucho menos, una de tal entidad y magnitud que pudiere dar lugar a la nulidad del proceso, máxime, cuando no se trata de la nulidad de los procesos luego de proferidas las sentencias de constitucionalidad, lo cual exige de una muy rigurosa carga argumentativa, la Sala Plena de la Corporación decidió RECHAZAR la nulidad pretendida, por resultar manifiestamente improcedente.
